Know Your Rights - Info For Renters, Patients, And Employees

By: Alex De Mostafa

It is important to know what your rights are and what to do if they are violated.

Renter Rights

As recently as the 1980's, owners of properties in Michigan had the right to evict a tenant simply because they wanted use of their property. They did not have to prove that their tenant was late on rent or had abused their property in some way. Whether the owner was renting out a mobile home, mobile home lot, apartment, condominium, or house, it was totally the right of that owner to evict for absolutely no reason at all.

In many instances, the tenant had reported some problem related to the property to the health department in that area as a last resort for assistance. Slum landlords often refused to make repairs that were essential to the survival of the tenants including furnaces, electricity, or water. When the tenants reported the problem, owners would take them to court and evict them. That is now called retaliatory eviction and is not allowed.

Rights of Patients

Even in this modern age when people everywhere are claiming their rights, it is difficult to gain access to medical files. When a patient goes in for special tests or minor surgical procedures, forms must be signed giving rights of access to the medical staff. Patients are required to sign a form showing that they have received information about their rights of privacy.

Doctors and hospitals refuse to give information about a patient's medical condition even to family members. Before the medical personnel can disclose any information about the patient, a form must be signed by the patient giving permission. Only two people can be listed on this form.

Many doctors and hospitals are reluctant to allow a patient access to their own medical files or those of a deceased child. Many parents have said they were told to get an attorney if they wanted access to their dead child's records.

Rights of Employees

Although many larger companies have a department called Human Resources in place to protect the rights of their employees, it is questionable whether or not their rights are actually protected.

Employees who question unethical practices of their bosses often find that they are fired or laid off after making a complaint to Human Resources. One such employee said that he was encouraged to discuss his situation with Human Resources after having been verbally abused and threatened by his supervisor. However, some time after he had the meetings with Human Resources, he was told that his position had been eliminated and he was indefinitely laid off.

Although the perpetrator was subsequently fired, that was not much consolation to the injured employee who had blown the whistle. Unemployment compensation was not enough to keep his bills paid. The situation left him with a sour taste in his mouth for working for corporate America. He decided to become an entrepreneur.
